About Mediation

While keeping the law in mind, mediation enables you to resolve your differences in a non adversarial setting. With the guidance of Amelie, parties are able to find the solution to their custodial and financial issues.

The first step in your mediation will be to identify the issues that need to be addressed.  You will then share the relevant information to ensure that you are both informed.  This exchange of information will enable you to negotiate a workable resolution.

Once all issues are resolved, I will draft an agreement that will encompass the terms discussed and agreed upon.

Signing and filing

After signing the Agreement which encompasses all the agreed upon terms, you will have the option to have it filed with the Court and/or to file for divorce.  I can handle all those steps for you.

FAQ:  

 

DO I NEED AN ATTORNEY? at any time you can use a reviewing attorney to advise you outside of the mediation.  In addition, it is recommended that you have the final agreement reviewed by an attorney before signing it.  

DOES THE MEDIATOR MAKE DECISIONS FOR US? no I do not make decisions for you.  I help you come to an agreement.  I will advise you on what would happen in Court, but I am not there to make decisions for you.

WHAT ISSUES CAN BE MEDIATED?  any issues can be mediated and at any time.  Sometimes mediation deals with pre marriage issues, sometimes issues that arise during the marriage and sometimes issues that come up after the parties are separated or divorced.

When you hire me as your attorney, I will represent you and you only. 

Prenuptial and Postnuptial Agreements

-Prenuptial and postnuptial agreements are agreements which parties enter into either prior to or after the marriage to delineate the respective parties' financial rights during the marriage and/or in the case of divorce. 

Uncontested Divorce Filing

-Uncontested Divorce is when both parties come to an agreement without the assistance of the Court and need to file the divorce papers.  Some cases are mediated, others are resolved with both parties represented by attorneys but the case is never taken to Court until the filing of the divorce papers.

Separation Agreements

-Separation and Settlement Agreements are agreements between spouses who no longer want to be married.  Such agreements can be filed as part of a divorce or the parties can wait to file for divorce if they are not ready to do so.  These agreements can be reached through mediation or with the assistance of an attorney.

-Mediation Consulting and Review is recommended when you are in the mediation process and are seeking legal and practical advice to assist you in preparing for your mediation and to have an attorney review your final agreement.

A Little About Amelie Kraus

Amelie Kraus graduated from Brandeis University in 1996 and earned her Juris Doctorate in 1999 from the Benjamin N. Cardozo School of Law and was the recipient of the New York State Bar Association Legal Ethics Award.  Ms. Kraus began her career as a staff attorney at the Center for Battered Women's Legal Services at Sanctuary for Families.  Ms. Kraus then spent three years as an associate at Goldweber, Lauriello and Epstein, LLP woking on matrimonial and family law matters.  Ms. Kraus started her own matrimonial practice in 2003.  She then founded Kraus, Diamond and Fee, PLLC a matrimonial firm focusing on litigated matrimonial and family law cases.  In 2017 Ms. Kraus decided to focus on mediating matrimonial and family law matters to assist parties in reaching out of court agreements. She founded the Law and Mediation Offices of Amelie Kraus, LLC.

Amelie Kraus is fluent in French and Spanish.   

Amelie Kraus is admitted to the New York State Bar and is a member of the New York State Bar Association and 

a Certified Mediator by the Center for Mediation and Training.  Ms. Kraus is also a certified Collaborative Lawyer.

Amelie Kraus is also very involved in serving her community and has been a member of Impact100 Westchester since its inception.  She served as Co-President for two years and is currently responsible for negotiating grant agreements and providing legal advice in the day to day management of the organization.
